Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and PickU Rides (“PickU,” “we,” “us,” or “our”) governing your access to and use of the PickU Rider app, PickU Driver app, website, and related services (collectively, the “Services”).
By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Who we are
PickU Rides operates a technology platform that connects riders seeking transportation with independent drivers. PickU is not a transportation carrier. Trips are provided by independent drivers, not by PickU employees, except where expressly stated.

2. Eligibility
- You must be at least 18 years old and legally able to enter a binding contract.
- You must provide accurate registration information and keep it up to date.
- Drivers must hold a valid driver’s licence, insurance, and any permits required by local law.
- You may not use the Services if your account has been suspended or terminated.
3. The Services
PickU provides a marketplace and communication tools to request, offer, and pay for rides. We may modify, suspend, or discontinue features at any time with or without notice, to the extent permitted by law.
4. Rider terms
- You are responsible for the accuracy of pickup, drop-off, and stop locations.
- You agree to pay applicable fares, fees, tolls, tips, and taxes shown in the app.
- You must behave respectfully toward drivers and comply with applicable laws.
- Cancellation fees may apply as shown in the app at the time of cancellation.
- Promotional codes and discounts are subject to stated conditions and may be revoked for misuse.
5. Driver terms
- You represent that you are authorized to operate your vehicle and carry passengers.
- You are an independent contractor, not an employee or agent of PickU, unless otherwise required by law.
- You are responsible for your vehicle condition, licensing, insurance, and compliance with local regulations.
- You may accept or decline ride requests according to app rules and availability settings.
- Payouts are subject to verification, Stripe Connect or other payout provider terms, and applicable fees.
6. Payments
Payments are processed by third-party payment providers (e.g., Stripe). By adding a payment method, you authorize charges for completed trips and applicable fees. All amounts are displayed in Canadian dollars (CAD) unless otherwise stated.
Refunds and fare adjustments are handled according to our policies and applicable law. Chargebacks or payment disputes may result in account suspension.
7. User conduct
You agree not to:
- Use the Services for unlawful purposes or harassment
- Impersonate another person or provide false information
- Interfere with the operation or security of the Services
- Attempt unauthorized access to accounts, systems, or data
- Use the Services to transport illegal goods or engage in fraud
8. Ratings, reviews, and support
Users may rate and review trips. We may remove content that violates these Terms or applicable law. Support requests should be sent to support@pickurides.com.
9. Intellectual property
The Services, including software, logos, and content, are owned by PickU or its licensors. You receive a limited, non-exclusive, revocable licence to use the apps for personal or driver business use as intended. You may not copy, modify, or reverse engineer the Services except as permitted by law.
10. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICKU DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
PickU does not guarantee uninterrupted service, specific arrival times, or the conduct of any user. Use of the Services is at your own risk.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PICKU AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO PICKU IN THE THREE (3) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
12. Indemnification
You agree to indemnify and hold PickU harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or third-party rights.
13. Termination and account deletion
We may suspend or terminate your access at any time for violation of these Terms, fraud, safety concerns, or legal requirements.
You may stop using the Services at any time. To delete your data:
- Riders: use in-app Settings → Delete account in the PickU Rider app (see our Privacy Policy — data deletion).
- Drivers: email support@pickurides.com to request account deletion.
14. Disputes between users
PickU may help facilitate communication but is not a party to agreements between riders and drivers. Disputes regarding trips should be reported through the app or support channels promptly.
15. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Courts in Ontario shall have exclusive jurisdiction, except where consumer protection laws in your jurisdiction require otherwise.
16. Changes
We may update these Terms from time to time. Continued use after the effective date constitutes acceptance. If you do not agree to updated Terms, you must stop using the Services and may delete your account.
